AB 83 - Extends Personal Liability Immunity for “Good Samaritans” to Laypersons

Effective August 6, 2009, Assembly Bill 83 (hereinafter “AB 83”) extends personal liability immunity to all persons who render emergency medical or non-medical care or assistance at the scene of emergencies, not just emergency workers. Any person who makes a good faith effort to render assistance during an emergency is protected under this immunity, as long as any harm potentially caused during the rescue was not the result of the “Good Samaritan’s” gross negligence or willful or wanton misconduct.
